Course Enrollment Agreement
When you enroll in a NY Lifeguard course, you enter into a binding agreement governed by these terms and conditions. Acceptance may be completed electronically and carries the same legal weight as a handwritten signature. Any individual registering on behalf of another participant affirms that they have permission to do so.
NY Lifeguard reserves the right to cancel, postpone, or reschedule any course due to circumstances outside of its control, including but not limited to severe weather, instructor availability, facility issues, public health mandates, or governmental action. In such cases, participants will be offered a rescheduled date or alternative option as determined by NY Lifeguard.
Enrollment in a course does not guarantee certification. Certification is granted only after the participant successfully completes all required skills, written exams, and performance evaluations as mandated by the American Red Cross.
Assumption of Risk and Physical Requirements
Certain NY Lifeguard courses involve physical activity that may be strenuous in nature. Aquatic courses may require swimming, deep-water skills, endurance activities, lifting, and prolonged physical exertion. CPR and First Aid courses require participants to kneel, perform repetitive chest compressions, and engage in hands-on skill demonstrations.
Participants acknowledge that they are voluntarily enrolling and confirm that they are physically capable of completing all course requirements. NY Lifeguard is not responsible for injuries, medical conditions, or physical limitations that may arise during training.
By attending a course, participants assume all risks associated with training activities and agree that participation is at their own discretion.
Refund and Cancellation Policy Overview
NY Lifeguard incurs immediate administrative, instructor, and facility costs once a registration is completed. As a result, all refund, cancellation, and transfer requests are subject to the policies outlined below. No exceptions will be made outside of these terms.
Refund eligibility is based on both the time of purchase and the scheduled class start date. Requests must be submitted within the required timeframes to be considered.
Non-Aquatic (Land-Based) Courses
(CPR, First Aid, AED, and Similar Programs)
- Refund requests submitted within 72 hours of registration and more than 24 hours before the scheduled class start time are eligible for a 75% refund, with a 25% administrative fee retained.
- Within this same timeframe, participants may instead request a 100% course credit, valid for one (1) year from the original purchase date.
- Refund requests submitted after 72 hours from registration are not eligible for refunds or credits for any reason.
- Course transfers are permitted after 72 hours for a $35 transfer fee, provided the transfer is completed within four (4) months of the original registration date.
- Registrations made within 24 hours of the scheduled class start time are final sale and not eligible for refunds or credits. Transfers may still be permitted under the $35 transfer policy and applicable time limits.
Aquatic Courses
(Lifeguarding, Water Safety, and Water-Based Programs)
Registrations made within 24 hours of the scheduled class start time are considered final sale. No refunds or credits will be issued. Transfer options may still be available under the $100 transfer policy and time limitations.ed. Discounts and promo codes may not combine with other offers or be applied retroactively.

Refund requests made after 72 hours from registration are not eligible for refunds or credits.
Participants may request to transfer to another session for a $100 transfer fee, provided the transfer occurs within four (4) months of the original purchase date.
Online Courses and Digital Content
All online-only courses offered by NY Lifeguard are non-refundable and non-transferable. Access to online course materials is granted immediately upon purchase, which constitutes full delivery of the product. Once access is issued, no refunds, credits, exchanges, or transfers will be permitted under any circumstances.
Participants are responsible for completing all required online components within the designated timeframe set forth by the American Red Cross. Failure to complete the online portion prior to the in-person session may result in removal from the course without refund.
Missed Classes and Incomplete Attendance
Participants who fail to attend a scheduled class, arrive late, leave early, or miss any required portion of a course will be considered incomplete and will not be eligible for a refund or credit.
Missed classes for any reason—including illness, travel delays, work conflicts, or personal emergencies—are not refundable. Depending on the course type, participants may be required to pay a re-enrollment or retake fee to attend a future session.
NY Lifeguard is not responsible for missed coursework resulting from participant scheduling conflicts or failure to comply with course timelines.
Failed Courses, Assessments, and Skill Evaluations
Certification is not guaranteed upon enrollment. Participants must successfully complete all written exams, skill demonstrations, and performance evaluations required by the American Red Cross.
Participants who do not meet the minimum passing standards for written exams or skills assessments are not eligible for refunds. In some cases, a retest or skills review session may be offered for an additional fee, subject to instructor and facility availability.
Failure to pass a retest or complete remediation may require full re-enrollment in the course at the standard tuition rate.
Attendance Requirements and Participant Conduct
Full attendance is required for all NY Lifeguard courses. Participants must arrive on time, remain for the entire duration of the class, and actively participate in all required activities.
NY Lifeguard reserves the right to remove any participant from a course for disruptive behavior, failure to follow instructor directions, unsafe conduct, falsification of information, or violation of course policies. Removal from a course will result in forfeiture of all fees paid, with no refund, credit, or transfer provided.
Participants are expected to maintain a professional and respectful environment for instructors and fellow students at all times.
Instructor Discretion and Course Integrity
All instructors are authorized representatives of the American Red Cross and NY Lifeguard. Instructor decisions regarding skill performance, testing outcomes, and course completion are final and must be respected.
Attempts to bypass course requirements, falsify attendance, or interfere with course integrity may result in permanent disqualification from NY Lifeguard training programs.
Administrative Fees and Chargebacks
Administrative fees may apply for special requests, including but not limited to instructor form completion, duplicate certificates, or verification documentation.
Chargebacks or payment disputes initiated without first contacting NY Lifeguard may result in additional processing fees. Fraudulent disputes may lead to suspension from future course enrollment.
Required Materials and Equipment
Participants are responsible for bringing all required materials, equipment, and attire specified for their course. This may include, but is not limited to, swimsuits, towels, appropriate footwear, writing materials, or any other items communicated prior to the course start date.
Failure to arrive with the required equipment may prevent participation in course activities and may result in an incomplete or unsuccessful course outcome. In such cases, no refunds, credits, or transfers will be issued.
Gift Certificates and Promotional Offers
All gift certificates purchased through NY Lifeguard are final sale and may not be redeemed for cash or refunded once issued. Gift certificates must be used in accordance with their stated terms and expiration dates, if applicable.
Promotional discounts, coupon codes, and special offers may not be combined unless explicitly stated. Discounts cannot be applied retroactively to previous purchases or to courses that have already been completed or attended.
Certification Records and Documentation
Participants are responsible for ensuring that all personal information provided during registration is accurate. NY Lifeguard is not responsible for delays or issues related to incorrect participant information submitted at the time of enrollment.
Requests for replacement certificates, verification letters, or instructor-completed forms may be subject to administrative fees and processing timelines.
Policy Acknowledgment and Acceptance
By registering for a course with NY Lifeguard, participants acknowledge that they have reviewed and accepted all refund, transfer, attendance, and participation policies outlined on this page. These policies apply to all courses regardless of delivery method or location.
NY Lifeguard reserves the right to update or modify these policies at any time without prior notice. The version published on this website at the time of registration governs course participation.
