1. Use of Website
This website is intended for individuals seeking information about lifeguard training, certification, recertification, staffing, and related services. You agree to use this site for lawful purposes only and not to engage in any activity that may harm the website, its users, or NY Lifeguard.
2. Course Registration & Payment
- Full payment is required at the time of registration.
- Registration is not confirmed until payment is successfully processed.
- Course availability is subject to change based on enrollment, instructor availability, and facility access.
3. Eligibility & Prerequisites
Participants are responsible for verifying that they meet all course prerequisites, including age, physical ability, swimming skills, and certification requirements. Failure to meet prerequisites may result in removal from the course without refund.
4. Attendance & Participation
- Participants must arrive on time and attend all required sessions.
- Late arrival or early departure may result in non-certification.
- Active participation in both classroom and in-water activities is required.
5. Certification
Certification is issued only upon successful completion of all course requirements, including skills evaluations and written exams. NY Lifeguard does not guarantee certification or employment.
Certifications are issued by the American Red Cross or other certifying bodies where applicable and are subject to their rules and validity periods.
6. Refunds, Transfers & Rescheduling
All refunds, transfers, and rescheduling requests are governed by the Refunds & Course Policies page. By registering, you acknowledge and accept those policies.
7. Health & Safety Assumption of Risk
Lifeguard training involves physical activity, including swimming and rescue simulations. By participating, you acknowledge and assume all risks associated with physical training and aquatic environments.
Participants confirm they are physically capable of participating and have no medical conditions that would prevent safe participation unless disclosed in advance.
8. Limitation of Liability
To the fullest extent permitted by law, NY Lifeguard shall not be liable for any injury, loss, damage, or claim arising from participation in training, use of facilities, or reliance on information provided on this website.
9. Conduct
NY Lifeguard reserves the right to remove any participant for unsafe behavior, misconduct, disruption, or failure to follow instructor guidance. Removal may result in non-certification without refund.
10. Intellectual Property
All website content, course materials, logos, text, and graphics are the property of NY Lifeguard or its licensors and may not be reproduced, distributed, or used without written permission.
11. Third-Party Services
Certain services, including payment processing and certification issuance, may be handled by third-party providers. NY Lifeguard is not responsible for third-party policies, systems, or outages.
12. Lifeguard Staffing Services
Staffing services are subject to separate agreements. NY Lifeguard does not guarantee continuous coverage, specific personnel, or uninterrupted staffing due to factors outside its control.
13. Privacy
Use of this website is also governed by our Privacy Policy, which outlines how personal information is collected, used, and protected.
14. Modifications
NY Lifeguard reserves the right to update or modify these Terms at any time without prior notice. Continued use of the website or services constitutes acceptance of the updated Terms.
